Simplified Genuine Temporary Entrant (GTE) Requirements

Effective 2 August 2024, the SC 482 visa policy for the Short-Term Stream has undergone significant simplification concerning the Genuine Temporary Entrant (GTE) requirements. 

 

The new approach assumes that the GTE criteria are met by default, unless there are specific concerns that suggest otherwise.

 

Importantly, the new policy does not consider the holding of multiple temporary visas (including other 482 Short Term visas) or extended stays in Australia without departure as factors against meeting the GTE criteria.

 

Factors that may indicate the GTE requirement is not met under the current policy include:

 

  • Non-compliance with the conditions of previous visas, having had a visa cancelled, or being under consideration for cancellation

  • Significant inconsistencies in the information provided in the TSS visa application that cannot be resolved 

  • Submission of two or more unsuccessful TSS visa applications,

  • Being part of a group identified in statistical, intelligence, or analysis reports on migration fraud and immigration compliance by the Department.

  • An applicant or their family member having a problematic immigration history, including previous visa refusals or non-compliance with immigration requirements in another country.
